PocketSurvey Ltd Terms of Service

These Terms of Service ("Terms") govern your use of the PocketSurvey software (the "Software"). By accessing or
using the Software, you agree to be bound by these Terms. If you do not agree to these Terms,
please do not use the Software.
2. Software Use
- You may use the Software for your own personal or business purposes.
- You may not white label, distribute, or sell the Software.
- You may not use the Software for any illegal or unauthorized purpose.
- You can configure and customise the Software to suit your requirements, but the responsibility for the accuracy
of the changes you make lies solely with you.
3. Data Privacy
PocketSurvey Ltd is committed to protecting your privacy. Please refer to our Privacy Policy for more information on
how we collect, use, and protect your data.
4. Intellectual Property
The Software and all related materials are the property of PocketSurvey Ltd and are protected by copyright and other
intellectual property laws.

5. Disclaimer of Warranties
The Software is provided "as is" without warranties of any kind, either express or implied. PocketSurvey Ltd does
not warrant that the Software will be error-free or meet your specific requirements.
6. Limitation of Liability
PocketSurvey Ltd shall not be liable for any damages arising from your use or inability to use the Software,
including but not limited to direct, indirect, incidental, special, or consequential damages.
7. Customer Support
We're committed to providing helpful customer support.

- We're typically available weekdays from 10:00 AM to 4:00 PM.
- We'll try to respond within 7 business days, but times may vary.
- Our goal is to assist you, but we can't guarantee solutions to all problems.
- Disclaimer: We're not responsible for any losses or damages arising from your use of the
Software, even if you've contacted customer support.
8. Payment & Invoices
Prompt payment of invoices is required to maintain an active subscription.

Failure to pay invoices on time will result in your app being paused. After 7 days of being paused your app and
your
data may be deleted unless you tell us that's your failed payment is temporary.

You will be charged a surcharge of £2.50 for any failed Direct Debit payments.
9. Refunds and Cancellations
Please take note of our annual and monthly subscription terms.
- Annual Subscriptions
No refunds will be provided for annual subscriptions that are cancelled partway through the subscription term. By
purchasing an annual plan, you agree to commit to the full term of service, regardless of early cancellation or
non-use of the service.
This policy ensures fair pricing for all users and supports ongoing service delivery, maintenance, and
development costs throughout the subscription period.
- Monthly Subscriptions
You may cancel your monthly subscription at any time, provided that you give at least 7 days notice before your
next invoice date.
10. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations under these Terms if such delay or
failure is caused by a Force Majeure Event.
A "Force Majeure Event" means any event beyond the reasonable control of the
affected party, including but not limited to acts of God, acts of war, terrorism, civil unrest, epidemics,
pandemics,
natural disasters, or government actions.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
11. Amendments
PocketSurvey Ltd may revise these Terms from time to time. Your continued use of the Software after such revisions
shall constitute your acceptance of the amended Terms.
